A terrified witness to a gang-related murder doesn't have to testify - and prosecutors can use statements he made to cops instead, a judge ruled yesterday.

Bronx Judge Ann Donnelly decided that witness Theodore Edwards, 22, was "unavailable" to testify because he was "subject to threats and outright physical attacks."

Edwards was jumped and beaten in the summer of 2009; a brick was thrown through the window of his former home four months ago; and he was shot in the arm last week, authorities said at a hearing yesterday.

Prosecutors said they also confiscated letters from murder defendant Brandin Santiago's jail cell in which Edwards was called a "snitch" and marked for death.

They wanted Edwards to testify about the murder of prep-school student Nadairee Walters, 17, who was shot outside a Morris Heights house in 2008, allegedly by Santiago.

They asked that the courtroom be closed when he took the stand, but members of the press objected.

The judge briefly closed the courtroom yesterday during a hearing on the matter - then ruled that Edwards does not have to speak before the jury.

"He won't testify," said Edwards' mom, Patricia. "If he testifies he has to go back to the same 'hood. What do you think will happen?"
